These Terms of Service govern your use of the Hocare platform operated by Holuvantage Ltd. By subscribing to or using Hocare, you agree to these terms. Please read them carefully before using the service.
1. Definitions
In these Terms:
- "Holuvantage", "we", "us" means Holuvantage Ltd, registered in England & Wales
- "Hocare" means the care management platform accessible at hocare.holuvantage.com
- "Organisation" means the subscribing care provider or business accessing Hocare
- "Administrator" means a user with administrative access designated by the Organisation
- "User" means any individual authorised by the Organisation to access Hocare
- "Service" means the Hocare platform and all associated features
- "Subscription" means the paid or trial access arrangement between Holuvantage and the Organisation
2. The service
Hocare is a care management platform designed for UK home care providers. It includes GPS-verified visit tracking, electronic medication administration records (eMAR), incident reporting, document management, staff management, a family portal, AI-assisted documentation, and CQC Quality Scoring.
Hocare is a tool to assist care management. It does not constitute clinical advice, replace professional care judgement, or guarantee compliance with any regulatory framework. The Organisation remains responsible for care quality, CQC compliance, and regulatory obligations at all times.
3. Account registration and access
To use Hocare, the Organisation must complete registration and provide accurate information including organisation name and a valid contact email address. The registered contact email will be treated as the Organisation's administrator account.
The Organisation is responsible for:
- Maintaining the confidentiality of all login credentials
- Ensuring all users are appropriately authorised and trained
- All activities that occur under the Organisation's account
- Notifying Holuvantage promptly of any unauthorised access or security breach
4. Free trial
New organisations are offered a 60-day free trial. During the trial period, full platform functionality is available. No charge is applied during the trial period. A valid payment method is required to begin the trial. If the Organisation cancels before the end of the trial period, no charge will be made. At the end of the trial period, the Organisation's selected subscription plan will begin and the payment method on file will be charged automatically.
5. Subscription and payment
Subscriptions are billed monthly per active user seat at the rates applicable to the chosen plan at the time of subscription. Current pricing is published at hocare.holuvantage.com.
Payment is processed by a third-party payment provider. Holuvantage does not store payment card details. All payments are in pounds sterling (GBP). Subscriptions renew automatically each month unless cancelled. No refunds are provided for partial months.
Holuvantage reserves the right to amend pricing with 30 days' written notice to the Organisation's registered contact email.
6. Acceptable use
You agree to use Hocare only for lawful purposes and in accordance with these Terms. You must not:
- Use Hocare to process personal data beyond the scope of your Organisation's care activities
- Attempt to gain unauthorised access to any part of the platform or another organisation's data
- Upload malicious code, viruses, or any content designed to disrupt or damage the platform
- Use Hocare to store, process or transmit content that is unlawful, harmful, or offensive
- Reverse engineer, decompile, or attempt to extract the source code of Hocare
- Resell, sublicense or transfer your subscription to any third party without our written consent
- Use automated tools, bots, or scrapers to interact with the platform
7. Data and confidentiality
The Organisation owns all data entered into Hocare by its users. Holuvantage processes this data only to provide the Service and in accordance with the Data Processing Agreement.
Holuvantage will maintain the confidentiality of Organisation data and will not disclose it to third parties except as required to provide the Service, as required by law, or with the Organisation's explicit consent.
On termination of a subscription, Organisation data is retained for 90 days, during which the Organisation may request a data export. After 90 days, data is securely deleted unless a longer retention period is required by law.
8. Intellectual property
Hocare, including all software, design, content, trademarks and documentation, is owned by Holuvantage Ltd and is protected by UK and international intellectual property law. Nothing in these Terms grants the Organisation any ownership rights in Hocare.
The Organisation retains all intellectual property rights in data, care records and documentation it creates using Hocare.
9. Availability and maintenance
Holuvantage aims to maintain Hocare availability at or above 99.9% measured monthly. Planned maintenance will be notified in advance where possible. Holuvantage does not guarantee uninterrupted access and accepts no liability for downtime beyond refund of the pro-rated subscription fee for extended outages exceeding 24 hours.
10. Limitation of liability
Important: Hocare is a management and record-keeping tool. It is not a substitute for professional clinical judgement, care planning expertise, or regulatory compliance advice. The Organisation remains solely responsible for the quality and safety of care delivered.
To the maximum extent permitted by applicable law:
- Holuvantage's total liability to the Organisation under or in connection with these Terms shall not exceed the total subscription fees paid in the 12 months preceding the claim
- Holuvantage shall not be liable for any indirect, consequential, special or punitive damages
- Holuvantage shall not be liable for any care outcomes, regulatory findings, or CQC inspection results
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
11. Termination
Either party may terminate the subscription at any time with 30 days' written notice. The Organisation may cancel immediately via the platform settings. Holuvantage may terminate or suspend access immediately if the Organisation materially breaches these Terms, fails to pay fees, or uses the platform in a manner that puts the security or integrity of the platform or other users at risk.
12. Changes to these terms
Holuvantage may update these Terms from time to time. Material changes will be communicated to the Organisation's registered contact email at least 30 days before taking effect. Continued use of Hocare after that date constitutes acceptance of the updated Terms.
13. Governing law and disputes
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. We encourage you to contact us first to resolve any dispute informally before initiating legal proceedings.
